Welcome to the Sarah Lee v. TTCU Federal Credit Union Settlement Website
If you have or had a checking account with TTCU Federal Credit Union, F/K/A TTCU The Credit Union, F/K/A Tulsa Teachers Credit Union and you were charged an overdraft fee or insufficient funds fee between August 31, 2015, and May 1, 2024, then you may be entitled to a payment from a class action settlement (1).
(1) The relevant fees are APSN Fees, ACH RET Fees, Multiple NSF Fees, or NSF Fees and OD Fees that were charged instead of a Transfer Fee when a Settlement Class Member had sufficient funds in their savings, money market or other similar account to cover a checking account transaction for which there were not sufficient funds in the checking account. “ACH RET Fee” means any fee charged that TTCU charged and did not refund during the Class Period that was labeled as a “ACH RET FEE” on a customer statement of account. “APSN Fee” means an overdraft fee that TTCU charged and did not refund during the Class Period on signature point-of-sale debit card transactions when there was a sufficient balance at the time the transaction was authorized, but an insufficient balance at the time the transaction was presented to TTCU for payment and posted to a customer’s account. “Multiple NSF Fees” means non-sufficient funds fees that were charged by TTCU during the Class Period for ACH and check transactions that were re-submitted by a merchant after being rejected for insufficient funds. “Transfer Fee” means any fee charged and not refunded during the Class Period to transfer money from a customer’s savings, money market or other similar account to cover checking account transactions for which there were not sufficient funds.
SUMMARY OF YOUR OPTIONS AND THE LEGAL EFFECT OF EACH OPTION
These rights and options – and the deadlines to exercise them – along with the material terms of the settlement are explained in this notice.
DO NOTHING
If you do not do anything, you will receive a cash payment or account credit from the Settlement Fund or forgiveness of uncollected overdraft fees, overdraft transfer fees or insufficient funds fees, provided you do not opt out of or exclude yourself from the Settlement.
EXCLUDE YOURSELF FROM THE SETTLEMENT; RECEIVE NO PAYMENT BUT RELEASE NO CLAIMS
You can choose to exclude yourself from the Settlement or "opt out." This means you choose not to participate in the Settlement. You will keep your individual claims against TTCU, but you will not receive a cash payment, account credit or the forgiveness of uncollected overdraft fees or insufficient funds fees. If you exclude yourself from the Settlement but want to recover against TTCU, you will have to file a separate lawsuit or claim.
OBJECT TO THE SETTLEMENT
You can file an objection with the Court explaining why you believe the Court should reject the Settlement. If your objection is overruled by the Court, then you will receive a cash payment, account credit, or forgiveness of uncollected overdraft fees or insufficient funds fees and you will not be able to sue TTCU for the claims asserted in this litigation. If the Court agrees with your objection, then the Settlement may not be approved.
